FlyFit Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the FlyFit mobile application (the "App"), operated by Fly Bodies ("Fly Bodies," "we," "us," or "our"). Please read these Terms carefully before using the App.

1. Acceptance of Terms

By creating an account, downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the App. Your continued use of the App constitutes ongoing acceptance of these Terms, including any updates made in accordance with Section 22 (Changes to Terms).

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent and warrant that you meet these eligibility requirements and that any registration information you provide is truthful and accurate.

Certain challenges, clubs, or communities within the App (such as school or alumni groups) may have additional eligibility requirements, such as affiliation with a specific school, company, or organization.

3. Account Registration

To access certain features of the App, you must create an account. You agree to:

Provide accurate, current, and complete information during registration;
Keep your account information up to date;
Maintain the confidentiality of your login credentials;
Not share your account with others or use another person's account;
Notify us immediately of any unauthorized access to or use of your account.

You are responsible for all activity that occurs under your account. Fly Bodies is not liable for any loss or damage arising from your failure to protect your account credentials.

4. Purpose of the App

FlyFit is a wellness and fitness platform that provides features including step tracking, mileage challenges, workout logging, clubs and teams, leaderboards, educational content, feed posts, and community engagement tools.

FlyFit is a wellness tool only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

5. Health and Wellness Disclaimer

The App provides general wellness, fitness, and educational information. This information is not intended to be, and should not be treated as, medical advice, diagnosis, or treatment.

Always consult a physician or qualified healthcare provider before beginning any exercise program, fitness challenge, or wellness activity, especially if you have a pre-existing medical condition, injury, or health concern.
Never disregard professional medical advice or delay seeking it because of information or content available through the App.
Participation in physical activities, challenges, and exercise programs carries inherent risks, including the risk of injury. You participate voluntarily and at your own risk.
If you experience pain, dizziness, shortness of breath, or discomfort during any activity, stop immediately and seek medical attention.

6. Activity Tracking and Data Accuracy Disclaimer

The App tracks and displays activity data such as steps, mileage, workouts, calories, and related metrics. You acknowledge and agree that:

Step counts, mileage, calorie estimates, workout data, leaderboard rankings, and synced health data are estimates and may vary based on your device, wearable, phone settings, third-party integrations, sensor accuracy, and user input.
Fly Bodies does not guarantee the accuracy, completeness, or reliability of any activity or health-related data displayed in the App.
Activity data should not be relied upon for medical, health, or safety decisions.
Leaderboard rankings and challenge results are based on data as received and processed by the App and may be affected by syncing delays, device errors, or third-party service issues.

7. Third-Party Integrations

The App may allow you to connect third-party services and devices, including Apple Health, Google Health Connect, Fitbit, Garmin, and similar platforms ("Third-Party Integrations"). You acknowledge that:

Third-Party Integrations are governed by their own terms of service and privacy policies, which you should review;
Fly Bodies does not control and is not responsible for the accuracy, availability, or functionality of Third-Party Integrations;
Data synced from third-party services may be delayed, incomplete, or inaccurate;
Changes made by third-party providers may affect App features that rely on their data;
Your use of the App is also subject to the applicable terms of the Apple App Store and Google Play Store (see Section 15).

8. User Conduct

You agree to use the App lawfully and respectfully. You will not:

Harass, bully, threaten, intimidate, or abuse other users;
Impersonate any person or entity, or misrepresent your identity or affiliation;
Cheat in challenges, including manually manipulating step counts, using device shaking or automation tools, submitting false or fabricated activity data, or otherwise gaming leaderboards;
Engage in fraud, spam, or deceptive practices;
Post unlawful, obscene, hateful, discriminatory, or otherwise inappropriate content;
Interfere with or disrupt the App, its servers, or its security features;
Attempt to reverse engineer, decompile, or extract the source code of the App;
Use the App for any commercial purpose without our prior written consent;
Collect or harvest information about other users without their consent.

Violation of this section may result in removal from challenges, forfeiture of prizes, suspension, or termination of your account.

9. User-Generated Content

The App includes features that allow you to post content, such as feed posts, comments, photos, messages, team feeds, and profile information ("User Content"). You are solely responsible for your User Content. You agree that your User Content will not:

Violate any law or the rights of any third party (including privacy, publicity, and intellectual property rights);
Contain harassing, hateful, defamatory, sexually explicit, violent, or otherwise objectionable material;
Contain false, misleading, or fraudulent information;
Contain unsolicited promotions, advertising, or spam.

Fly Bodies does not endorse User Content and reserves the right (but has no obligation) to review, moderate, remove, or restrict any User Content at any time, for any reason, without notice.

10. Content License

You retain ownership of your User Content. By posting, uploading, or submitting User Content to the App, you grant Fly Bodies a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, display, reproduce, and distribute your User Content within the App and related services for the purpose of operating, promoting, and improving the platform. This license ends when your User Content is deleted from the App, except where content has been shared with others who have not deleted it, or where retention is required by law.

11. Community Guidelines

FlyFit is built around community. When participating in clubs, challenges, feeds, comments, and other community features, you agree to:

Treat other members with respect and courtesy;
Keep discussions constructive and appropriate for a diverse community, which may include students, alumni, and workplace groups;
Refrain from personal attacks, discriminatory remarks, or exclusionary behavior;
Report inappropriate behavior or content through the App's reporting tools.

Fly Bodies may issue warnings, remove content, restrict features, or suspend or terminate accounts of users who violate these guidelines.

12. Challenges and Prizes

The App may offer challenges, competitions, and prizes. Unless otherwise stated in specific challenge rules:

Eligibility: Challenges may be limited to certain groups, organizations, regions, or user types. Additional eligibility rules may apply and will be stated where applicable.
Fair Play: Users may be disqualified or removed from a challenge for cheating, manually manipulating steps or activity data, submitting false data, harassing other participants, or violating challenge rules or these Terms.
Winners and Tie-Breakers: Winners are determined based on the criteria stated in the applicable challenge. In the event of a tie, Fly Bodies may apply tie-breaker criteria at its reasonable discretion.
Prizes: Prizes are subject to availability and may be substituted with items of equal or greater value. Prizes are non-transferable and may not be exchanged for cash unless required by law. Winners are responsible for any applicable taxes.
Decisions Final: Fly Bodies' decisions regarding challenge administration, results, disqualification, and prizes are final.

13. Payments and Subscriptions

Certain features of the App may require payment or a subscription. If applicable:

Pricing will be displayed in the App or applicable app store prior to purchase;
Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date;
Purchases and subscriptions made through the Apple App Store or Google Play Store are billed and managed by the applicable app store, and refunds are subject to that store's policies;
Except where required by law or by the applicable app store policy, payments are non-refundable;
Prices are subject to change; we will provide notice of price changes as required by applicable law and app store rules;
You are responsible for any applicable taxes.

14. Intellectual Property

The App, including its software, design, features, branding, logos, text, graphics, and all other content (excluding User Content), is owned by Fly Bodies or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the App without our prior written consent.

15. App Store Terms

Your use of the App is also subject to the terms and policies of the platform through which you downloaded it, including the Apple App Store Terms of Service and the Google Play Terms of Service. In the event of a conflict between these Terms and applicable app store terms regarding billing or platform requirements, the app store terms will control to the extent of the conflict. Apple and Google are not parties to these Terms and have no obligation to provide support or maintenance for the App.

16. Privacy

Your privacy is important to us. Our collection, use, and sharing of personal information — including your name, email, school or company affiliation, steps, mileage, workouts, health-related app data, device data, and analytics data — is described in our Privacy Policy, available at [Insert Privacy Policy Link]. The Privacy Policy is a separate document and is incorporated into these Terms by reference. By using the App, you acknowledge that you have reviewed the Privacy Policy.

17. Push Notifications

The App may send you push notifications, including activity reminders, challenge updates, community activity, and other App-related messages. You can manage or disable push notifications at any time through your device settings or in-App notification preferences. Disabling certain notifications may limit your ability to receive challenge or account-related updates.

18. Termination

Fly Bodies may suspend, restrict, or terminate your account or access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, our Community Guidelines, or applicable law, or if your conduct harms other users, Fly Bodies, or third parties. You may stop using the App and delete your account at any time. Upon termination, your right to use the App immediately ceases. Sections that by their nature should survive termination (including Sections 5, 6, 10, 14, and 19–21) will survive.

19. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. FLY BODIES DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DATA (INCLUDING ACTIVITY AND HEALTH-RELATED DATA) WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY BODIES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, PARTICIPATION IN ANY CHALLENGE OR PHYSICAL ACTIVITY, RELIANCE ON ANY DATA OR CONTENT IN THE APP, OR THE CONDUCT OF OTHER USERS, EVEN IF FLY BODIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY BODIES' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FLY BODIES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

21. Indemnification

You agree to indemnify, defend, and hold harmless Fly Bodies and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your User Content; (c) your violation of these Terms; (d) your violation of any law or the rights of any third party; or (e) your participation in any challenge or physical activity.

22. Dispute Resolution

Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.

Informal Resolution. Before filing a claim, you agree to first contact us at admin@flybodies.co and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

Arbitration. Any dispute arising out of or relating to these Terms or the App that cannot be resolved informally will be resolved by binding individual arbitration administered by American Arbitration Association under its applicable rules, rather than in court, except that either party may bring an individual claim in small claims court.

Class Action Waiver. You and Fly Bodies agree that any dispute will be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Venue. For any dispute not subject to arbitration, you and Fly Bodies consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware.

23. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App, by email, or by other reasonable means, and update the "Last Updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

24. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy and any challenge-specific rules, constitute the entire agreement between you and Fly Bodies regarding the App.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
